Managing General Counsel Department: Counsel Location: Albany, NY START YOUR APPLICATION Position Title: Managing General Counsel Grade/Classification: 68 - Managing Senior Director FLSA Status: Exempt Application Deadline: July 28th, 2017 Primary Purpose The Managing General Counsel oversees the legal services provided to management and staff in relation to public clients, private clients or policy and administration, ensuring they are competent and consistent with the policies and objectives of DASNY. Essential Functions Supervise staff in particular area of operations (public clients, private clients or policy and administration) and the quality of legal advice being given to other divisions of DASNY related to construction, procurement, liens, public finance, asset management, workouts, corporate matters, labor relations, human resources, grant administration, investments, litigation, insurance, eminent domain, environmental affairs and/or real estate. Apprise General Counsel of all significant activities and advise General Counsel when his/her involvement in an activity is needed. Serve as deputy to General Counsel and act for the General Counsel with respect to certain designated areas in the General Counsel's absence. Advise Construction Services on complex matters pertaining to procurement, contractor claims, liens and bonds, including the preparation and review of legal documents pertaining thereto. Coordinate with the Attorney General's Office and manage outside counsel in connection with litigation in which DASNY is involved. Supervise bond counsel and review and prepare legal documents used in connection with DASNY's debt issuances. Supervise the administration of various grant programs, including the formulation of policies and procedures with respect thereto, and related reporting. Act as the liaison with New York State agencies and Legislative houses involved in the administration of the various grant programs. Advise DASNY staff with respect to general corporate matters such as Freedom of Information Law (FOIL) requests, ethical issues, insurance matters, systems issues and real estate matters. Participate and advise DASNY on labor matters, including collective bargaining negotiations, arbitrations and disciplinary proceedings. Prepare legislation and render advice on DASNY's legislative program; prepare reports to the Governor regarding pending legislation. Review and provide legal advice with respect to investment, custodial, wire transfer and other agreements for the Finance division. Provide legal counsel with respect to the annual audit. Provide legal services related to Board matters. Prepare and monitor departmental operating budget. Other Duties and Responsibilities Maintain current knowledge of statutory and regulatory changes that relate to the operations of DASNY. Train and evaluate employees. Ensure supervisors meet their obligations in the supervision, training and evaluation of their staff. Counsel employees and assist in handling stage 1 grievances and disciplinary measures in accordance with applicable collective bargaining agreements. Direct the development, documentation and implementation of procedures. Direct the assessment, development, implementation and testing of internal controls. Undertake special assignments as directed. Must maintain regular attendance in accordance with DASNY attendance and leave policies. Must adhere to the NYS Information Security Policy Standards established and issued by the NYS Office of Information Technology Services. (Standards can be found on the Intranet.) Supervision Supervision of employees is required. Physical/Mental/Visual Demands Physical/Mental/Visual Demands: Frequent travel may be required using public transportation, DASNY vehicle, rental vehicle or personal vehicle. This travel may include overnight stays at public accommodations and related establishments. Requires complex and time-pressured decision-making. Must be able to work overtime or extended work hours as needed. Work Environment Standard office environment, including the use of one or more of the following: PC, telephone, fax machine, printer, copier, scanner, electronic stapler/hole punch/date stamp, shredder. Minimum Qualifications Juris Doctor, admission to the New York State Bar and thirteen years experience in the practice of law subsequent to admission to the Bar, including ten years experience supervising and evaluating professional staff. Management experience.
