National IAM Benefit Trust Fund – Washington, DC

National IAM Benefit Trust Fund, headquartered in Washington, DC, is seeking an experienced employee benefits attorney with excellent managerial skills. As Fund Counsel, you will oversee all legal aspects of the Fund while working under the direction of the Board of Trustees.

Responsibilities include, but are not limited to:
•Ensures compliance with government regulation
•Ensures plan benefits are paid in accordance to plan documents
•Monitors and ensures all government filings/reports are completed as required and documents and notices are distributed timely to plan participants
•Represents the Board of Trustees in contacts with governmental agencies
•Acts as resource for Fund staff on all aspects of legal compliance
•Advises Trustees on fiduciary issues
•Provides Trustees legal education
•Corresponds with contributing employers on legal issues
•Corresponds with plan participants and/or their attorneys on legal issues
•Drafts and reviews contracts
•Researches proposed and existing legislation affecting the Fund and advises Trustees and departments concerned
•Reviews Forms 5500 and 990
•Gives legal advice with respect to Fund administration
•Consults/advises on Plan compliance matters
•Advises Trustees and other parties on changes in laws and regulations
•Drafts and updates procedures
•Drafts and updates plan document, trust agreement and SPDs
•Reviews SMMs and other required plan notices, and drafts as necessary
•Responds to HIPAA legal questions
•Reviews and updates HIPAA Procedures Handbook on regular basis
•Recommends legal action when necessary
•Prepares RFPs and RFP summaries
•Reviews delinquency letters
•Responds to requests for documentation
•Drafts Board of Trustee’s agenda
•Drafts legal documents for Board of Trustee’s meetings
•Review’s Board of Trustee’s minutes
•Updates eligibility guidelines
•Gathers and researches data for litigation and negotiations

Qualifications:
•Juris Doctor degree with strong academic credentials
•Bar admission in Washington, DC
•7+ years of legal experience with all aspects of health and welfare plans, with at least five years’ experience working with multiemployer health and welfare plans
•In-depth knowledge of ERISA, HIPAA, ACA, and IRC
•Proven managerial/leadership skills
•Excellent research and writing skills
•Litigation experience working on fiduciary issues, benefit denials, collections, and withdrawal
•liability is desired
•Understanding of basic principles of labor relations, related labor laws and employment law preferred
